ELSO Releases & Waivers
If you are selected to participate in this cohort, you agree to the following releases and waivers.
Model Release
I AM EITHER 18 YEARS OLD AND SIGNING ON BEHALF OF MYSELF OR I AM THE PARENT OR GUARDIAN OF A PARTICIPANT AND SIGNING ON THEIR BEHALF. With this Model Release, I hereby give the ELSO Incorporated team, board members, employees, contractors, and other assigns herein referred to as (“ELSO”) my permission to use Content such as images (photography or videography), voice recordings, art (designs, drawings, paintings, sculptures, crafts, etc.), and/or testimonial (interviews, quotes, survey responses, etc.) captured during their participation in ELSO related programming and activities.
This includes granting permission for the content to be used for media purposes including but not limited to advertising, promotion, testimonials, traditional and social media marketing, educational seminars or workshops, and website content. I agree that the Content may be combined with other images, text, graphics, film, audio, audio-visual works; and may be cropped, altered or modified.
I agree that the Content will belong to ELSO. I acknowledge and agree that I have no right, now or in the future, to compensation relating to Content formation or use, and that I will make no further claim for any reason to ELSO. I acknowledge and agree that this release is binding upon my heirs and assigns. I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the law of the State of Oregon.
It is agreed that ELSO will not sell or license Content to any third parties unless given explicit permission by Participant. ELSO shall not make personal information (real names and addresses) publicly available unless explicitly authorized.
Should any disputes arise that are not resolved with good faith negotiation processes, I agree prior to filing any claim(s) in court, to mediate the dispute with ELSO with the guidance of a third-party neutral mediator.
Participant Waiver
We care about you and your safety. As a result, we require that all who wish to be involved with ELSO activities as a participant read and sign this assumption of risk/liability waiver. You are referred to as “I” or “My” below. We are referred to as “ELSO.”
I AM EITHER 18 YEARS OLD AND SIGNING ON BEHALF OF MYSELF OR I AM THE PARENT OR GUARDIAN OF A PARTICIPANT AND SIGNING ON THEIR BEHALF. I hereby assume all of the risks of working, participating, or volunteering in this activity or event that may arise. In consideration of my voluntarily choosing to participate in activities with ELSO, I hereby take action for myself, my family, or anyone that may have a legal claim on my behalf as follows:
A) I UNDERSTAND that during my participant involvement, I may be photographed and/or videoed. I acknowledge that in order to participate as a participant, I must sign ELSO’s “Model Release” form.
B) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to liability arising from the negligence or fault of the ELSO from my personal injury, property damage, property theft, death, disability, or actions of any kind. This covers not just the duration of the event but any time I participate (even if minimally) in setting up or breaking down. This also covers anything that may occur while traveling to or from my participant involvement. Should I choose to drive my vehicle, another participant’s vehicle, or a vehicle owned or leased by ELSO, I am 100% responsible for any and all liabilities or damages incurred relating to vehicle use. I acknowledge that ELSO does not have insurance that covers any of these circumstances and that should something occur, they will not be held responsible based on said acknowledgement.
C) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the ELSO for any and all liabilities or claims made as a result of participation in this activity or event regardless of cause. I acknowledge that this activity or event may involve inherent risks including but not limited to those caused by using power tools, building tools or supplies, yard or garden equipment, loading items, a condition at a facility, weather, health conditions of other guests or participants, equipment, and actions of anyone present. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and/or illness during this activity or event, not at the cost of the company.
D) In the course of participating, I may come into contact with, or acquire knowledge about or relating to ELSO’s employees, contractors, vendors, donors, other participants, or a child and/or child’s family receiving services information including but not limited to information or data pertaining to employees, contractors, processes, specifications, drawings, sketches, models, samples, computer programs, marketing or strategic plans, which information may be in written or oral form (“Information”). Such Information is, and shall remain, the exclusive property of the ELSO. participants shall treat and maintain all such Information as confidential, whether or not it has been physically marked as Confidential.
E) In the course of participating, I may come into contact with Personally Identifiable Information (“PII”). PII is information relating to an individual that reasonably identifies the individual and, if compromised, could cause harm to that individual (ELSO’s employees, contractors, vendors, donors, other participants, or a child and/or child’s family receiving services). I shall maintain adequate administrative, technical and physical safeguards against unauthorized access, use, or disclosure of PII or any other Confidential Information. I will immediately report to ELSO (the person supervising my participant shift or role) any unauthorized access, use, loss, disclosure, modification or destruction of PII or Confidential Information within 24 hours of discovery. In such event I will (i) use best efforts to determine the scope and nature of the breach; (ii) cooperate with Company, in light of the circumstances and applicable law, to determine risks posed by the breach and whether and how those persons whose data was accessed, acquired or disclosed should be notified; (iii) restore the reasonable integrity of the data system which hosts the PII or Company’s Confidential Information without compromise to forensic investigation.
F) I acknowledge that the world is currently in a pandemic state. I understand that by participating at this time outside of my home, I am putting myself and potentially others at risk of contracting COVID-19. I am aware that this could lead to not just illness or death of myself but to others in my life. I agree to follow not just current government health and safety standards, but to follow rules set forth by ELSO. This includes wearing a mask during the event at all times, maintaining as much distance as possible at all times, and washing and sanitizing hands as needed. I agree to personally assume any and all liability should I contract COVID-19 during/from participating with ELSO. I acknowledge that maintaining my health and safety during these times is my full responsibility and I will take it seriously.
I ATTEST THAT I HAVE READ, UNDERSTAND, AND AGREE TO THESE WAIVERS AND ALL TERMS AND CONDITIONS HEREIN
